PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY

These General Terms and Conditions shall expressly govern the relationships that arise between Jazz Messengers Club SL, Jazz Messengers Club SL, with Tax Registration Number ESB63970057,registered at Registro Mercantil of Barcelona, Tomo 37914, F-129 H.B311188,  and  (hereafter, "Jazz Messengers Club SL") and the third parties (hereafter, "Users") who register as users and /or purchase products through the official Jazz Messengers Club SL website online store (http:// www.jazzmessengers.com ", (hereafter the "Store").

 

2. USER’S DUTIES

2.1 The User agrees to use the Store to purchase the Products and to use each of the services of the Store diligently under the law, morality, public order and provisions hereof. He must also prevent himself from using the said Products or services in any way that may prevent, damage or deteriorate the normal operation and use of the Store on the part of the Users or that may harm or cause damage to Jazz Messengers Club SL goods and rights as well as to those corresponding to its suppliers, Users or, in general, any third party.

 

3. PRODUCTS AND PRICES

3.1 Jazz Messengers Club SL reserves the right to decide, at all times, the Products that are offered to the Users through the Store. In particular, Jazz Messengers Club SL may at any time add new Products to the ones offered or included in the Store, understanding that unless otherwise provided, such new Products shall be governed by the provisions of these General Terms and Conditions. Also, Jazz Messengers Club SL reserves the right to stop providing or facilitating the access and use at any time and without prior notice of any of the different types of Products that are offered in the Store.

 

3.2 The Products included in the Store shall match, as truly as the website display technology allows, the Products effectively offered. The characteristics of the Products and their prices are displayed in the Store. The prices given in the Store are in Euros and do not include VAT, unless otherwise provided.

4. PRODUCT PROCEDURE AND WAY OF PAYMENT

4.1 Within a maximum term of twenty-four (24) hours, Jazz Messengers Club SL shall send an e-mail to the User confirming the purchase. This e-mail shall give a purchase reference code and shall give detail of the characteristics of the Product, its price, shipping & handling costs and those corresponding to the several options regarding the payment thereof to Jazz Messengers Club SL

 

4.2 The User who purchases a Product through the Store must make the payment using the payment options specifically detailed in the Store.

 

4.3 Jazz Messengers Club SL shall file the electronic documents formalising the contract and shall send a copy to the User once the purchase has been made. The contract shall be drawn up in Spanish/Catalan/English.

 

4.4 The confirmation of the order sent by Jazz Messengers Club SL is not valid a invoice, but it’s simply a purchase receipt. Jazz Messengers Club SL shall send the invoice with the Product to which it refers.

 

5. WAIVER RIGHT

5.1 The User has the right to waive the purchase, for which he may contact Jazz Messengers Club SL at the following e-mail address: info@jazzmessengers.com and waive the purchase within a period of no more than seven (7) working days as of the Product reception. The Product should be sent together with the fully completed return form and a fully completed copy of the delivery note or of the invoice thereof. Jazz Messengers Club SL shall pay the Product direct return cost, which should be performed in accordance to the instructions that Jazz Messengers Club SL gives to the User in reply to his waiver notification. The User must return the Product within the maximum term of seven (7) days after Jazz Messengers Club SL indicates the User to do so.

 

5.2 The waiver involves the refund of paid monies. In order to do this, the customer must state the number and holder of the credit card to which Jazz Messengers Club SL should make the refund on the returns form. The term for this refund shall be the one stated by Law.

 

5.3 The waiver right may not be exercised if the Product is not returned in its original packaging and when the Product is not in perfect conditions.

 

6. CUSTOMER CARE SERVICE

 

6.1 For any defect, claim or exercise of his rights, the User may send an e-mail to the following address: info@jazzmessengers.com.

 

7. HOME DELIVERY SERVICE

7.1 The geographical area of sales through the Store is exclusively for the European Union, meaning that the delivery service shall only be rendered within this area. Products bought through the Store shall be sent to the delivery address stated by the User once payment has been verified. The maximum delivery term is of thirty (30) days such as stated by Law.

 

7.2 The Jazz Messengers Club SL delivery service is performed in collaboration with a number of logistics operators of acknowledged prestige. Orders shall not be sent to Post Office Boxes, hotels or other non-permanent addresses.

 

7.3 The shipping & handling cost is not included in the price of the Products. At the time of purchase of the Product, the User shall be informed of the exact shipping & handling costs.

 

8. INTELLECTUAL AND INDUSTRIAL PROPERTY

8.1 The User acknowledges that all elements of the Store and of each of the Products, the information and materials contained therein, the trademarks, the structure, selection, arrangement and presentation of its contents, and the computer programs used in relation to the said Products are protected by intellectual and industrial property rights belonging to Jazz Messengers Club SL or to third parties, and that in regards to these industrial and intellectual property rights the General Terms and Conditions do not give him any other rights than those specifically covered thereof.

 

8.2 Unless authorised by Jazz Messengers Club SL or, as the case may be, by the third-party holders of the corresponding rights, or except if allowed by law, the User shall not reproduce, transform, modify, disassemble, perform inverse engineering, distribute, rent, lend, make available, or allow access to the public through any way of public communication of any of the elements referred to in the previous paragraph. The User must use the materials, elements and information to which he has access through the use of the Store solely for his own needs, agreeing not to perform whether directly or indirectly, any commercial use of the materials, elements and information obtained thereof.

 

8.3 The User must prevent himself from avoiding or handling any technical devices established in the Store by Jazz Messengers Club SL or by third parties.

 

9. DATA PROTECTION

9.1 In compliance with the Personal Data Protection Act 15/99, we are informing you that your personal details and other information provided by means of the registration form and from the transactions made, shall be included and kept on a file belonging to Jazz Messengers Club SL until you request it to be cancelled. The treatment thereof shall be used for the performance and execution of the sale, the personalised care of the products and services that you purchase and the improvement thereof as well as the promotion of proprietary products and services and those of third companies related to Jazz Messengers Club SL

In the same way, we are informing you that your details shall be made available to the companies for the stated purposes / Jazz Messengers Club SL which shall treat these data with the utmost confidentiality, being the sole and exclusive recipient thereof, and which shall not make any assignments or communications to third parties other than those stated by current regulations.

 

9.2 The User may, at any time, exercise the rights of access, rectification, opposition or cancellation by addressing Jazz Messengers Club SL, Jazz Messengers Club SLX or by means of e-mail addressed to info@jazzmessengers.com, to which a copy of his ID. Number shall be attached thereto.

9.3. Replies marked with an * on the registration form are mandatory. Failure to answer the said questions shall prevent the purchase of the selected products from being completed.

 

10. PASSWORDS

10.1 Jazz Messengers Club SL shall provide personal passwords to the user who signs in on the website. These passwords shall be used to have access to the services provided by the Website. The user must keep the passwords under his exclusive liability in the strictest and most absolute confidentiality, therefore being liable for the damages or consequences of any kind that arise from the breach or disclosure of the password. For security reasons, the user may change the telematic access passwords to the services related to the Website at any time. The User agrees to immediately inform Jazz Messengers Club SL of any unauthorised use of his password and of any access to the said password by unauthorised third parties.

 

11. COOKIES

11.1 Jazz Messengers Club SL uses cookies with the purpose of improving its services, aiding browsing, maintaining security, verifying the identity of the User, aiding access to personal preferences and monitoring the use of the Store. Cookies are files installed on the computer hard drive or in the browser memory in a folder previously configured by the User’s computer operating system for the purpose of its identification.

 

11.2 Should the User not want a cookie to be installed on his hard drive, he should configure his Internet browser in such a way that it does not accept the said cookies. In the same way, the User may freely destroy the cookies. In the event the User decides to disable the cookies, the quality and speed of the service may diminish and he may even lose access to some of the services offered in the Store.

 

12. APPLICABLE LAW AND JURISDICTION

These general terms and conditions are governed by Spanish legislation. Any dispute arising from the interpretation or execution that may occur in relation to the validity, interpretation, fulfilment or termination of this contract shall be submitted to the Jurisdiction of the Courts of the City of BARCELONA, and the User shall waive his jurisdiction as long as the applicable law allows the said waiver.

13. CONFIANZA ONLINE

All parts submit, by their own choice, to the resolution of any conflict and disregarding any other way, to the tribunals y juzgados of the user/consumer country. Furthermore, as a company under CONFIANZA ONLINE and agreeing to its ethical code of practice, in case of any dispute relating to contracting and advertinsing online, data protection, minors protection and accessability, the user will be free to remit to CONFIANZA ONLINE’s resolution system commitee

LEA ATENTAMENTE ESTAS CONDICIONES

Las presentes Condiciones Generales regularán expresamente las relaciones surgidas entre Jazz Messengers Club S.L., calle Corcega 202 bajos dcha, Barcelona ( Barcelona ), 08036, España , y con CIF B 63970057 y ,registrada en el  Registro Mercantil of Barcelona, Tomo 37914, F-129 H.B311188, (en adelante, "Jazz Messengers Club S.L.") y los terceros (en adelante, "Usuarios") que se den de alta como usuarios y/o adquieran productos a través de la tienda online del sitio web oficial de Jazz Messengers Club S.l.  (http://www.jazzmessengers.com", en adelante la "Tienda").

2.OBLIGACIONES DEL USUARIO
2.1 El Usuario se obliga, con carácter general, a utilizar la Tienda, a adquirir los Productos y a utilizar cada uno de los servicios de la Tienda de forma diligente, de conformidad con la ley, la moral, el orden público y lo dispuesto en estas Condiciones Generales, y deberá asimismo abstenerse de utilizarlos en cualquier forma que pueda impedir, dañar o deteriorar el normal funcionamiento y disfrute de la Tienda por parte de los Usuarios o que pudiera lesionar o causar daños a los bienes y derechos de Jazz Messengers Club S.l., sus proveedores, Usuarios o en general de cualquier tercero.

3. PRODUCTOS Y PRECIOS
3.1 Jazz Messengers Club S.L. se reserva el derecho a decidir, en cada momento, los Productos que se ofrezcan a los Usuarios a través de la Tienda. En particular, Jazz Messengers Club S.L. podrá en cualquier momento adicionar nuevos Productos a los ofrecidos o incluidos en la Tienda, entendiéndose que salvo que se disponga otra cosa, tales nuevos Productos se regirán por lo dispuesto en las presentes Condiciones Generales. Asimismo, Jazz Messengers Club S.L. se reserva el derecho a dejar de prestar o facilitar el acceso y utilización en cualquier momento y sin previo aviso de cualquiera de las distintas clases de Productos que se ofrecen en la Tienda.
3.2 Los Productos incluidos en la Tienda se corresponderán de la forma más fidedigna posible que permita la tecnología de visualización en web a los Productos efectivamente ofrecidos. Las características de los Productos y sus precios aparecen en la Tienda. Los precios indicados en la Tienda son en Euros y incluyen el IVA, salvo indicación en contrario.
3.3 En caso de producto defectuoso, el Jazz Messengers Club S.L. deberá proceder, según corresponda, a la reparación, sustitución, rebaja del precio o resolución del contrato, gestiones que serán gratuitas para el consumidor y usuario. Jazz Messengers Club S.L. responde de las faltas de conformidad que se manifiesten en un plazo de dos años desde la entrega. El consumidor y usuario deberá informar al vendedor de la falta de conformidad en el plazo de dos meses desde que tuvo conocimiento de ella.

4.PROCEDIMIENTO Y FORMA DE PAGO DE LOS PRODUCTOS
4.1 En el plazo máximo de veinticuatro (24) horas, Jazz Messengers Club S.L. enviará un correo electrónico al Usuario, confirmándole la compra. Dicho correo electrónico asignará un código de referencia de la compra, y detallará las características del Producto, su precio, los gastos de envío y los datos de las distintas opciones para efectuar el pago de los Productos a Jazz Messengers Club S.L.
4.2 El Usuario que adquiera un producto a través de la Tienda deberá efectuar el pago mediante los sistemas de pago específicamente detallados en la Tienda.
4.3 Jazz Messengers Club S.L. archivará los documentos electrónicos en los que se formalice el contrato, remitiendo una copia al Usuario una vez hecha la compra. El contrato se realizará en la lengua española.
4.4 La confirmación del pedido enviada por Jazz Messengers Club S.L. no tiene validez como factura, solo como comprobante de compra. Jazz Messenegrs Club S.L. enviará junto al Producto la factura correspondiente al mismo.

5. DERECHO DE DESISTIMIENTO
5.1 El usuario tiene un derecho de desistimiento por el que podrá ponerse en contacto con Jazz Messengers Club S.L. a través del correo electrónico en la siguiente dirección: customerservice@jazzmessengers.com y desistir de la compra en un plazo no superior a siete (7) días hábiles, contados a partir de la recepción del Producto. El Producto deberá enviarse junto con la hoja de devolución debidamente cumplimentada y una copia del albarán de entrega o de la factura, debidamente cumplimentada,, corriendo a cargo de Jazz Messengers Club S.L. el coste directo de devolución del Producto. Dicha devolución se hará de conformidad con las instrucciones que Jazz Messengers Club S.l. indique al Usuario en contestación a su notificación del ejercicio de desistimiento. El Usuario deberá devolver el Producto en el plazo máximo de siete (7) días desde que Jazz Messengers Club S.L. le indique la forma de devolución.
5.2  El desistimiento conlleva la devolución del importe pagado. Para ello, el cliente deberá indicar en la hoja de devolución el número y el titular de la tarjeta de crédito a la que Jazz Messengers Club S.L. deberá efectuar el abono. El plazo para dicho abono será el establecido en la Ley.
5.3 No podrá ejercitarse el derecho de desistimiento cuando el Producto no se devuelva en su embalaje original y cuando el Producto no esté en perfecto estado.


6.  SERVICIO DE ATENCIÓN AL CLIENTE
6.1 Para cualquier incidencia, reclamación o ejercicio de sus derechos, el Usuario podrá enviar un correo electrónico a la dirección customerservice@jazzmessengers.com

7. SERVICIO DE ENTREGA A DOMICILIO
7.1  El ámbito territorial de las ventas a través de la Tienda es exclusivamente para el territorio de la Unión Europea, por lo que el servicio de entrega sólo será para dicho territorio. Los Productos comprados a través de la Tienda se enviarán a la dirección de entrega que el Usuario indique una vez comprobado el pago, siendo el plazo máximo de entrega el de treinta (30) días establecido por defecto en la Ley.
7.2   El servicio de entrega de Jazz Messengers Club S.L., se realiza en colaboración con distintos operadores logísticos de reconocido prestigio. No se servirán pedidos en Apartados de Correos ni en hoteles u otras direcciones no permanentes.
7.3  El coste de los envíos no está incluido en el precio de los Productos. En el momento de adquisición del Producto, el Usuario será informado del coste exacto de envío.

8. PROPIEDAD INTELECTUAL E INDUSTRIAL
8.1 El Usuario reconoce que todos los elementos de la Tienda y de cada uno de los Productos, la información y materiales contenidos en los mismos, las marcas, la estructura, selección, ordenación y presentación de sus contenidos, y los programas de ordenador utilizados en relación con ellos, están protegidos por  derechos de propiedad intelectual e industrial de la propia Jazz Messengers Club S.L.  o de terceros, y que las Condiciones Generales no le atribuyen respecto a dichos derechos de propiedad industrial e intelectual ningún otro derecho distinto de los específicamente contemplados en las mismas.
8.2 Salvo que fuera autorizado por Jazz MEssengers Club S.L. o en su caso por los terceros titulares de los derechos correspondientes, o a menos que ello resulte legalmente permitido, el Usuario no podrá reproducir, transformar, modificar, desensamblar, realizar ingeniería inversa, distribuir, alquilar, prestar, poner a disposición, o permitir el acceso al público a través de cualquier modalidad de comunicación pública de ninguno de los elementos referidos en el párrafo anterior. El Usuario deberá utilizar los materiales, elementos e información a la que acceda a través de la utilización de la Tienda únicamente para sus propias necesidades, obligándose a no realizar ni directa ni indirectamente una explotación comercial de los materiales, elementos e información obtenidos a través de los mismos.
8.3 El Usuario deberá abstenerse de eludir o manipular cualesquiera dispositivos técnicos establecidos por Jazz Messengers Club S.L. o por terceros en la Tienda.

9.  PROTECCIÓN DE DATOS
9.1 En cumplimiento de la Ley 15/99 LOPD, le informamos que sus datos personales y demás información facilitada mediante el formulario de inscripción, así como la procedente de las transacciones realizadas, será incluida y conservada en un fichero para su tratamiento, propiedad de Jazz Messengers Club S.L., mientras no se solicite su cancelación. El tratamiento se destinará al desarrollo y ejecución de la venta, la atención personalizada de los productos y servicios que adquiera y a la mejora de dicha atención, así como a la promoción de productos y servicios propios y de terceras empresas vinculadas a Jazz Messengers Club S.L..
Asimismo, se le informa que sus datos serán puestos a disposición de las empresas pertinentes para las finalidades indicadas/ Jazz Messengers Club S.L., calle Corcega 202 bajos dcha, Barcelona ( Barcelona ), 08036, España tratará estos datos con la máxima confidencialidad siendo el destinatario único y exclusivo de los mismos, y no efectuando cesiones o comunicaciones a terceros al margen de las señaladas por la normativa vigente.

El usuario autoriza expresamente a Jazz Messengers Club S.L., calle Corcega 202 bajos dcha, Barcelona ( Barcelona ), 08036, España la remisión, incluso a través de medios electrónicos, por parte de Jazz Messengers Club S.L., calle Corcega 202 bajos dcha, Barcelona ( Barcelona ), 08036, España y de  las citadas entidades, de comunicaciones comerciales y ofertas y concursos promocionales.
9.2 El Usuario podrá ejercer en cualquier momento los derechos de acceso, rectificación, oposición o cancelación dirigiéndose a Jazz Messengers Club S.L., c/ Corcega 202 bajos dcha, 08036, Barcelona (Barcelona), España o mediante correo electrónico dirigido a customerservice@jazzmessengers.com, adjuntando copia de su N.I.F. o documento identificativo sustitutorio.
9.3. Las respuestas marcadas con * en el formulario de inscripción tienen carácter obligatorio. Su no contestación impedirá que se pueda realizar la compra de los productos seleccionados.

10.  CONTRASEÑAS
10.1 Jazz Messengers Club S.L. facilitará el uso de contraseñas personales al usuario que se registre como tal en el sitio web. Dichas contraseñas servirán para el acceso a los servicios prestados por medio del Sitio Web. El usuario deberá mantener bajo su exclusiva responsabilidad las contraseñas en la más estricta y absoluta confidencialidad, asumiendo, por tanto, cuantos daños o consecuencias de todo tipo se deriven del quebrantamiento o revelación del secreto. Por razones de seguridad, la contraseña de acceso telemático a los servicios vinculados al Sitio Web podrá ser modificada en todo momento por el usuario. El Usuario se compromete a notificar a Jazz Messengers Club S.L. de forma inmediata cualquier uso no autorizado de su contraseña, así como el acceso por terceros no autorizados a la misma.

11.  COOKIES
11.1  Jazz Messengers Club S.L. utiliza cookies con el fin de mejorar sus servicios, facilitar la navegación, mantener la seguridad, verificar la identidad del Usuario, facilitar el acceso a las preferencias personales y seguir su uso de la Tienda. Las cookies son archivos instalados en el disco duro del ordenador o bien en la memoria del navegador en la carpeta preconfigurada por el sistema operativo del ordenador del Usuario para identificarle.
11.2  Si el Usuario no desea que se instale en su disco duro una cookie, deberá configurar su programa de navegación por Internet para no recibirlas. Igualmente, el Usuario podrá destruir las cookies libremente. En caso de que el Usuario decida desactivar las cookies, la calidad y rapidez del servicio pueden disminuir e, incluso, perderá el acceso a algunos de los servicios ofrecidos en la Tienda.

12. LEY APLICABLE Y FUERO
Las presentes condiciones generales se rigen por la legislación española. Cualquier controversia surgida de la interpretación o ejecución que pudieran surgir en relación con la validez, interpretación, cumplimiento o resolución del presente contrato se someterá a la Jurisdicción y Competencia de los Juzgados y Tribunales de la Ciudad de Barcelona, con renuncia al fuero que pudiera corresponder al Usuario, siempre que la legislación aplicable así lo permita.

13. CONFIANZA ONLINE
Las partes se someten, a su elección, para la resolución de los conflictos y con renuncia a cualquier otro fuero, a los juzgados y tribunales del domicilio del usuario. Asimismo, como entidad adherida a CONFIANZA ONLINE y en los términos de su Código Ético, en caso de controversias relativas a la contratación y publicidad online, protección de datos, protección de menores y accesibilidad, el usuario podrá acudir al sistema de resolución extrajudicial de controversias de CONFIANZA ONLINE (www.confianzaonline.es).
